Am I a U.S. Tax Resident? A Guide for South Africans Moving to America

U.S. immigration status and U.S. tax residency are related, but they are not the same question. A person can become a U.S. resident for federal tax purposes before receiving a green card, and the effective starting date can determine when worldwide income and foreign-asset reporting begin.

The green card test

In general, you meet the green card test if you are a lawful permanent resident of the United States at any time during the calendar year. Detailed rules determine the residency starting date, including where the green card and substantial presence tests are both met in the same year.

The substantial presence test

The test generally requires at least 31 days of U.S. presence in the current year and a weighted total of 183 days across the current and two preceding years. The calculation counts all qualifying current-year days, one-third of qualifying days in the preceding year and one-sixth of qualifying days in the second preceding year.

Not every day is counted the same way

Certain visa categories, medical circumstances, commuters and other situations may exclude days or create exceptions. The closer-connection exception and treaty positions have their own conditions and filing requirements; they should never be assumed from the day count alone.

Why the starting date matters

  • Resident aliens are generally taxed on worldwide income
  • Foreign accounts and assets may trigger FBAR, Form 8938 or other information returns
  • Foreign companies, funds and trusts can create additional forms and tax consequences
  • A dual-status year may require different return treatment
  • South African tax-residency cessation and treaty analysis must be coordinated separately
