Legal and privacy
Privacy Policy
Effective August 12, 2026. This policy explains how personal information is handled across the Emigrate2USA website, forms, consultations and services.
Emigrate2USA aims to collect only the information reasonably needed for the interaction or service. The free Quick Check does not intentionally submit its answers to us unless you separately complete a form or booking.
1. Who we are
Emigrate2USA Consulting ("Emigrate2USA", "we", "us" or "our") provides educational resources, consultations, practical journey guidance, business-establishment support and related services for people considering or navigating a move or expansion to the United States.
This Privacy Policy explains how we collect, use, disclose and protect personal information through emigrate2usa.co.za, related forms, booking processes, communications and services.
2. Information we may collect
Information you provide
- Name, email address, telephone number, country of residence and preferred contact details.
- Booking, enquiry, questionnaire and consultation information.
- Nationality, family, education, employment, business, investment and immigration circumstances that you choose to provide.
- Documents or messages submitted for a requested service.
- Transaction, invoice and service-history information.
Information collected automatically
- Internet Protocol address, browser, device, operating system and approximate location.
- Pages viewed, referral source, dates, times and interactions with the website.
- Cookie, analytics and similar technical information where those tools are enabled.
Please do not submit more sensitive information than the form or service requires. Do not send passwords, full payment-card details or unnecessary identity records by ordinary email.
3. Free Quick Check and paid Navigator
The free Visa Eligibility Quick Check is designed to generate broad reading suggestions inside your browser. Unless you separately submit a form, book a consultation or otherwise contact us, the answers selected in that public tool are not intentionally transmitted to Emigrate2USA.
The Enhanced Eligibility Navigator™ is available as a standalone paid digital product and is also included with Visa Path Consultation. Navigator answers and saved scenarios are stored in the customer’s WordPress account to provide reruns, saved findings and branded PDF reports. Up to 10 named scenarios may be saved. A customer may delete one scenario or all saved scenarios at any time. Saved scenarios are automatically removed 120 days after their most recent save unless deletion is requested sooner. The Navigator does not require passport numbers, Social Security numbers, A-numbers or document images, and customers should not enter them. Payment information is processed by the configured payment provider and is not stored in Navigator scenario records.
4. How we use information
- Respond to enquiries and provide requested resources or services.
- Manage bookings, consultations, payments, invoices and service communications.
- Prepare educational, organisational or journey-guidance outputs requested by a client.
- Maintain, secure, troubleshoot and improve the website and services.
- Understand use of the website and measure content performance where analytics are enabled.
- Prevent misuse, fraud, security incidents and unlawful activity.
- Comply with legal, tax, accounting and regulatory obligations.
- Send marketing communications only where permitted, with an available unsubscribe method.
Where applicable law requires a legal basis, we rely on consent, performance of a contract, legitimate interests, compliance with law or another permitted basis appropriate to the processing.
5. When information may be shared
We may share personal information only as reasonably necessary with:
- Website hosting, security, analytics, scheduling, email, document, payment and other service providers acting on our behalf.
- Independent specialists—such as immigration attorneys, tax advisers or other professionals—when you ask us to make an introduction or authorise the disclosure.
- Professional advisers, insurers, auditors or authorities where reasonably required.
- A successor or participant in a legitimate business transaction, subject to appropriate protections.
- Other parties when required by law, legal process, safety or the protection of rights.
Independent professionals have their own engagement terms and privacy practices. Emigrate2USA does not exchange personal information for money. Some privacy laws define certain analytics or advertising disclosures more broadly; where applicable, legally required choices and opt-out rights will be honoured.
6. Cookies and analytics
The website may use essential cookies for security and functionality and, where enabled, analytics or preference technologies. Browser settings can block or delete cookies, although doing so may affect site functionality. Third-party tools may set or read their own cookies according to their policies.
7. Retention and security
We keep personal information only as long as reasonably necessary for the purpose collected, the service relationship, dispute management and legal, accounting or recordkeeping duties. Retention periods vary by the type of information and the reason it is held. Navigator access lasts 90 days from successful payment; saved scenario records are retained for up to 120 days after their most recent save so deletion and account-administration requests can be completed, unless the customer deletes them sooner or requests deletion. Downloaded PDF reports are stored by the customer and are not automatically deleted from the customer’s device.
We use reasonable administrative, technical and organisational safeguards appropriate to the nature of the information. No website, email or storage method can be guaranteed completely secure.
8. International processing
Emigrate2USA works with people in the United States and internationally. Personal information may therefore be processed in the United States or other locations where we or our service providers operate. Those locations may have different data-protection laws. Where required, we use an appropriate lawful mechanism for international processing or transfer.
9. Your privacy choices and rights
Depending on where you live and subject to applicable exceptions, you may have rights to request access, correction, deletion, restriction, objection, portability or information about disclosures of personal information. You may also withdraw consent where processing relies on consent and unsubscribe from marketing communications.
To make a privacy request, use the contact method on the Book a Consult page and clearly label the message "Privacy Request". We may need to verify identity before completing a request.
10. Children
The website and services are intended for adults and are not directed to children under 13. We do not knowingly solicit personal information directly from children under 13. A parent or guardian should provide information about a minor only when relevant to a legitimate family enquiry or service.
11. Third-party websites
The website contains links to government agencies and independent third-party resources. Their privacy practices, content and security are governed by their own policies, not this Privacy Policy.
12. Updates and contact
We may update this Privacy Policy when our services, technologies or legal obligations change. The revised effective date will appear at the top of this page. Continued use of the website after an update is subject to the revised policy.
Questions or privacy requests may be submitted through the website contact and booking route.
